Watch and defense

The right to a mark should be watched and defended. It is of essential significance to the value of a mark that the mark itself has been defended against a younger mark, since the value of a mark increases automatically if there is no or just a limited environment!

The easiest way to watch a mark is to search for new registrations in the relevant registers and classes of goods/services and to oppose at the relevant Office within the opposition period.
After this term of opposition has lapsed, the owner of a mark can only enforce his rights before a Civil Court
and
after a five years toleration the rights to the mark are normally lost.
